Refund Policy

At Eerly AI, an Accely Company, we strive to provide our clients with exceptional value and satisfaction. However, we understand that circumstances may arise where a refund is requested. Please review our refund policy outlined below:

Refund Eligibility

Subscription Term: If a client chooses to cancel their subscription to our products and/or services early during the Subscription Term, Eerly AI will not provide any refunds.

Unused Services: Eerly AI does not provide refunds if a client decides to stop using our products and/or services during the Subscription Term. All unpaid fees due through the end of the Subscription Term must be promptly paid by the client.

Renewal: Upon renewal, Eerly AI reserves the right to adjust fees to reflect changes to our list prices, not exceeding five percent per year after the initial Subscription Term’s expiration. Fees may also be adjusted to reflect any usage exceeding the scope outlined in the applicable Order Form.

Payment and Invoicing

Invoicing: Unless otherwise specified, fees will be invoiced annually in advance. Invoices will be sent via email to the client’s designated billing contact.

Due Date: Fees reflected on the invoice will be due and payable upon receipt by the client.

Late Payment

Interest: Any payment not received by Eerly AI by the payment due date will accrue simple interest at a rate of 1.5% of the outstanding balance per month, or the maximum rate permitted by law, whichever is lower, from the due date until paid.

Exceptions: Late charges will not accrue on payments subject to a good faith dispute.

Disputed Payments

Dispute Process: Clients may dispute all or part of an invoice in good faith by providing written notice to Eerly AI within ten (10) days of the invoice date. The notice must include a description of the dispute.

Payment: Clients must pay all undisputed amounts when due and promptly pay all disputed amounts after the resolution of the dispute.

Suspension for Non-Payment

Account Suspension: If a client’s account is more than thirty (30) days past due, Eerly AI may suspend products and/or services upon ten (10) days written notice, except for fees subject to a good faith dispute.

Future Functionality

Non-Contingency: The client acknowledges that purchases under the Agreement are not contingent on the delivery of any future functionality or features.

Taxes

Tax Responsibility: Fees do not include any taxes or governmental assessments. Clients are responsible for paying all taxes associated with their purchase and use of our products and/or services.

Expenses

Reimbursement: Eerly AI is entitled to reimbursement of all reasonable, out-of-pocket expenses directly related to performing the services.
